Will the Frig convey if it was not in the contract


This was a question this week on the Texas Real Estate web site or what one might say TAR Texas Association of Realtors. Which we are a member of. 


Does the Frig convey if it was not in the contract. The answer is no it does not convey if it was not properly placed in the contract.

Does it stay with the house or does it go? 

The Frig is personal property and does it stay with the house? The answers is no it does not stay with the house unless it is agreed upon in the contract. Well one might ask how is it agreed upon in the contract? There is a form that TAR provides us to use as Realtors. This form is known as


This is the form that one would use to negotiate the Frig. 

Does it stay or does it go???

Place it on the NON-REALTY  form to ensure that all parties understand the frig is to stay with the house. 


Everything must be in writing to ensure that everyone has the same understanding of what is go happen within the contract. 


In the article that is being  referanced here... they state that the frig was to stay with the house because it was stated so in the MLS data sheet.


Well as per the article the frig must still be placed on the 

NON-REATLY  ADDENDUM form Which again gives way to the statement everything must be in writing.

We have a little box on our purchase contract for the refrigerator, washer, and dryer.  It makes things easy.  Best wishes to you Laura.

This is a question we get often and I also educate our buyer the need to put the refrigerator on a Non_Realty_Item_Addendum to ask for the refrigerator and offer $1.00 for consideration. Most buyer think it conveys but it up to us to educate our buyers. Very informative blog....thanks for sharing.
